1. Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and REV EV, also trading as REV Electric Vehicles ("REV EV," "we," "us," or "our"). They govern your access to and use of www.rev-ev.co and any related pages, forms, and communications (together, the "Site"), and they apply to inquiries you submit and to purchases you make from us.

By using the Site, submitting a contact form, or communicating with us by phone, text, or email, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. Who we are

REV EV is an American-owned business that sells the REV M2, a fully enclosed, air-conditioned, street-legal Low-Speed Vehicle ("LSV"), and arranges delivery to customers across the United States. You can reach us by phone or text at (833) 767-3838, or by email at legal@rev-ev.co.

3. Eligibility

You must be at least 18 years old and legally able to enter into a contract to submit an inquiry, consent to receive communications, or purchase a vehicle from us. If you are acting on behalf of a company, HOA, municipality, or other organization, you represent that you are authorized to bind that organization to these Terms.

4. Permitted use of the site

You may use the Site for lawful, personal, or legitimate business purposes only. You agree not to:

• submit false, misleading, or impersonating information, including a phone number you do not own or control;
• use the Site to transmit unlawful, harassing, or infringing material;
• attempt to gain unauthorized access to the Site, its systems, or its data;
• scrape, harvest, or automate collection of content or data without our written permission;
• interfere with the Site's operation or security, including by introducing malicious code;
• use the Site in violation of any applicable federal, state, or local law.

5. Inquiries, pricing and quotes

Submitting a contact form or requesting information does not create a purchase agreement and does not reserve a vehicle. All sales are subject to a separate written purchase agreement and to vehicle availability.

Prices shown on the Site — including any "starting at" price — are the base vehicle price in U.S. dollars, exclude destination and delivery fees, and exclude taxes, title, registration, licensing, documentation, and any other government or third-party charges. Prices, specifications, features, and availability are subject to change without notice and do not constitute an offer to sell.

We make reasonable efforts to keep specifications and imagery accurate, but the Site may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct any error and to decline or cancel an order arising from an error, including after an order has been submitted.

6. SMS and calling program terms

These terms govern the REV EV messaging program and are incorporated into your consent. They are provided to satisfy applicable wireless carrier and industry requirements for application-to-person (A2P) messaging.

6.1 Consent is optional and never required

Your consent to receive marketing or promotional text messages is not a condition of purchasing any vehicle, product, or service from us. You may submit an inquiry, request a quote, and buy a vehicle without opting in to marketing messages. If you decline, we will still contact you about your specific inquiry using the method you selected.

6.2 How to opt out

You may withdraw consent at any time by replying STOP to any text message from us. You will receive a single confirmation message and then no further messages, except that we may still contact you as needed regarding an active transaction. You may also opt out by calling (833) 767-3838 or emailing legal@rev-ev.co. Reply HELP to any message for assistance.

6.3 Carriers, rates and delivery

Message and data rates may apply. Message frequency varies. Wireless carriers are not liable for delayed or undelivered messages. We do not guarantee that any message will be delivered, and delivery depends on factors outside our control. Supported carriers may change without notice.

6.4 Your phone number

You represent that the phone number you provide is yours or that you are authorized to consent on behalf of its subscriber, and that it is not a number you are prohibited from using for this purpose. You agree to notify us promptly if you give up, transfer, or change that number.

6.5 Calls and recording

By providing a phone number and selecting phone as a contact method, you consent to receive calls from us at that number regarding your inquiry, which may be placed using automated technology. Calls may be monitored or recorded for quality and training purposes where permitted by law; you will be notified at the start of a call where notification is required.

7. Purchase, payment and delivery

Every vehicle sale is governed by a separate written purchase agreement, invoice, or bill of sale, which controls in the event of any conflict with these Terms. That agreement sets out the final price, deposit terms, payment method, delivery window, and cancellation and refund terms for your specific order.

Delivery timelines are estimates and are not guaranteed. Delivery may be affected by manufacturing schedules, carrier availability, weather, and other conditions beyond our control. Risk of loss passes as stated in your purchase agreement.

You are responsible for titling, registering, insuring, and lawfully operating the vehicle in your jurisdiction, and for any taxes and fees imposed by your state or municipality.

8. Low-Speed Vehicle regulatory disclosure

The REV M2 is manufactured as a Low-Speed Vehicle, a class of motor vehicle recognized under federal law, with a top speed of 25 mph. Where an LSV may lawfully be operated is determined by state, county, city, and municipal law, not by us. Rules on permitted roads, road crossings, titling, registration, licensing, insurance, equipment, and minimum operator age differ significantly between jurisdictions and change over time.

Statements on the Site describing the vehicle as "street-legal" refer to its federal vehicle classification and are general information only. They are not a representation that you may lawfully operate the vehicle on any particular road, in any particular community, or at all in your jurisdiction.

It is your responsibility to confirm current requirements with your state department of motor vehicles and local authorities before purchasing or operating the vehicle. We do not provide legal advice, and any general information we share about another customer's experience in your area is not a substitute for verifying the law yourself. You also remain subject to any rules imposed by a homeowners association or private community.

9. Warranty and disclaimers

Any warranty on a vehicle is set out in the written warranty documentation provided with your purchase. Nothing on the Site creates, expands, or modifies a warranty.

Range, speed, capacity, charging time, and battery life figures on the Site are estimates obtained under favorable conditions and will vary with terrain, load, temperature, speed, accessory use, driving style, tire condition, and battery age. They are not guarantees of performance.

Except as expressly stated in a written warranty or purchase agreement, the Site and all information on it are provided "as is" and "as available," and we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Site will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of certain implied warranties, so some of these exclusions may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, REV EV and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, arising out of or relating to your use of the Site, our communications with you, or any information on the Site — even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars ($100.00). Liability relating to a vehicle you purchase is governed by your purchase agreement and applicable warranty, not by this section.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or willful misconduct. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless REV EV and its owners, officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your breach of these Terms; your submission of a phone number you were not authorized to provide; your violation of any law or third-party right; or your operation of a vehicle in a manner not permitted in your jurisdiction.

12. Intellectual property

The Site and its contents — including text, photography, layout, graphics, and the REV and REV Electric Vehicles names and logos — are owned by us or our licensors and are protected by intellectual property laws. You may view and print pages for your personal, non-commercial use in evaluating a purchase.

You may not copy, reproduce, republish, distribute, or create derivative works from Site content, or use our names or logos, without our prior written permission. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

13. Third-party services and links

The Site uses third-party service providers to operate, including a form-processing provider that transmits contact form submissions to us, and may link to third-party sites such as social media profiles. We do not control third-party sites or services and are not responsible for their content, practices, or availability. Your use of a third-party service is governed by that provider's own terms and privacy policy.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to the paragraph below, you and we agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Harris County, Texas, and you and we consent to the personal jurisdiction of those courts.

Before filing any claim, you agree to contact us at (833) 767-3838 or legal@rev-ev.co and attempt to resolve the dispute informally for at least thirty (30) days. Most issues are resolved this way without either of us involving a court.

Any claim relating to the Site or these Terms must be brought within one (1) year after it arises, to the extent permitted by law. Nothing here prevents either party from seeking relief in a small-claims court or from seeking injunctive relief to protect intellectual property.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and material changes will take effect when posted. Your continued use of the Site after a change means you accept the revised Terms. Changes to the SMS program terms will not be applied retroactively to withdraw an opt-out you have already made.
